Terms of Service

These Terms of Service ("Terms") govern your access to and use of Founders Chat (the "Service"), provided by TenXAbility India Private Limited ("10xAbility", "we", "us"). By creating an account or using the Service you agree to these Terms.
1. Who Can Use the Service
The Service is provided to individuals and businesses using it to communicate with their own leads and customers over WhatsApp. You must have, or be eligible to create, a WhatsApp Business Account in your own name to connect it to the Service.
2. Your Account
- You are responsible for keeping your login credentials confidential and for all activity under your account.
- You must provide accurate information when creating your account and keep it up to date.
- If you invite team members, you are responsible for the access and permissions you grant them.
- Notify us immediately at connect@10xability.com if you suspect unauthorized access to your account.
3. What the Service Does
The Service lets you, depending on your plan:
- Connect a WhatsApp Business Account and reply to contacts from a shared inbox.
- Organise contacts into pipelines, send broadcasts, and use quick replies.
- Build automations/flows that respond to incoming messages.
- Optionally enable an AI agent, using your own OpenAI or Anthropic API key, to draft or send replies.
- Manage a subscription and view invoices.
4. WhatsApp Business Platform Compliance
You are responsible for complying with Meta's WhatsApp Business Policy and Meta's messaging/opt-in requirements for any contact you message through the Service, including only messaging people who have consented to be contacted by you. We may suspend automations or broadcasts that we reasonably believe put your WhatsApp Business Account, or our platform access, at risk of restriction by Meta.
5. Acceptable Use
You agree not to:
- Use the Service to send unsolicited bulk messages, spam, or content that violates WhatsApp's policies or applicable law.
- Attempt to gain unauthorized access to any part of the Service or another user's account or data.
- Reverse-engineer, scrape, or resell access to the Service without our written consent.
- Upload content that infringes a third party's rights or is unlawful, defamatory, or fraudulent.
6. Third-Party AI Providers
If you enable the optional AI agent, you are responsible for your own account and usage costs with your chosen AI provider (OpenAI or Anthropic), and for that provider's own terms. We simply pass your conversation content to the provider you configured, using the API key you supplied, to generate a reply.
7. Payments & Subscriptions
Payments are processed through Razorpay. Subscription fees are shown in your Billing page and reflected on invoices. Refund eligibility is governed by our Refund Policy.
8. Intellectual Property
The Service, its software, design, and the 10xAbility name and logo are the property of TenXAbility India Private Limited. You retain ownership of the business data (contacts, conversations, automations, etc.) you enter into the Service; you grant us a limited licence to host and process that data solely to provide the Service to you.
9. Third-Party Services
The Service integrates with third-party providers (Meta's WhatsApp Business Platform, OpenAI/Anthropic, Razorpay) that have their own terms and privacy policies. We are not responsible for the availability or conduct of these third-party services.
10. Disclaimers & Limitation of Liability
The Service is provided "as is" without warranties of any kind, to the maximum extent permitted by law. To the fullest extent permitted by applicable law, 10xAbility will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including any restriction or suspension of your WhatsApp Business Account by Meta. Nothing in these Terms limits liability that cannot be excluded under Indian law.
11. Suspension & Termination
We may suspend or terminate your access if you breach these Terms, misuse the WhatsApp Business Platform, or to protect the security or integrity of the Service. You may stop using the Service at any time; contact us to request account and data deletion.
12. Changes to These Terms
We may update these Terms from time to time. We'll update the "Last updated" date above when we do; continued use after a change means you accept the revised Terms.
13. Governing Law
These Terms are governed by the laws of India. Courts at Chandigarh, India have exclusive jurisdiction over any dispute arising from these Terms or the Service.
